Terms of Service

These Terms of Service apply between E1NSER (“we”, the provider of the Aivio – EU AI Labels Shopify app, see Imprint) and businesses that install the app via the Shopify App Store in their Shopify store (“merchant”, “you”). The app is offered exclusively to businesses (B2B); consumers are not party to these terms.

Aivio lets merchants mark product images in the Shopify admin as AI-generated or AI-edited and provides a storefront badge extension (theme app extension) for that purpose. Optionally, image files can be given a digital provenance signature (including C2PA/IPTC metadata). The app also offers a CSV export of all labels for documentation and audit purposes.

The merchant is responsible for the accuracy of the labels (AI-generated/AI-edited) they apply or confirm and must determine for themselves which labelling obligations apply to their products and market. Aivio supports merchants in technically implementing transparency duties under Article 50 of the EU AI Act, in particular through badges and metadata. Using the app does not replace the merchant’s own legal assessment and does not amount to an assurance that using the app, by itself, satisfies every requirement of the EU AI Act or any other applicable law. The merchant remains solely responsible for complying with the laws that apply to them.

When provenance signing is enabled, Aivio replaces the original image file in the Shopify media library with a signed version containing embedded provenance metadata. A backup copy of the original file is kept for 90 days; within that period the signing can be reverted via the app (restoring the original). After the 90-day period the backup is automatically deleted and restoration is no longer possible.

We aim to provide the app with high availability but do not guarantee uninterrupted access (e.g. due to maintenance, further development, or disruptions at third parties such as Shopify). We reserve the right to further develop, modify or discontinue features of the app; material changes will be announced where reasonably possible.

We are liable without limitation for intent and gross negligence and under mandatory statutory provisions (e.g. product liability law). Otherwise, our liability is limited in amount to the fees paid to us by the merchant in the twelve months preceding the event giving rise to the claim. We are not liable for the legal consequences arising from the merchant’s use or non-use of labels, including regulatory action or third-party claims relating to the EU AI Act or other laws.

The agreement runs for an indefinite period and ends when the merchant uninstalls the app from the Shopify admin. Upon uninstallation, associated data is deleted in accordance with our Privacy Policy.

These terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and Austrian conflict-of-laws rules. The competent court in Vienna, Austria has exclusive jurisdiction over any dispute arising out of or in connection with this agreement.

Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.
